Is Trading Taxed in Kenya? What Forex and Deriv Traders Should Know About Tax
Quick answer: Kenya taxes income, and regular trading profits can count as income that you declare to KRA in your annual return. The Digital Asset Tax (introduced in 2023 at 3%) was cut to 1.5% from 1 July 2025 under the Finance Act 2025; it targets transfers of digital assets such as crypto through platforms. How a specific product or your situation is taxed depends on the details, so keep full records and confirm with KRA or a tax adviser.

Is Forex Trading Taxed in Kenya?

Kenyan law taxes income, and the Kenya Revenue Authority looks at what you do, how often and why. Someone trading regularly to earn a living is more likely to be treated as running a business, with profits taxed as income. Occasional activity can be treated differently. There is no special exemption for forex or synthetic-index trading.

The Digital Asset Tax

The Finance Act 2023 introduced a Digital Asset Tax on the transfer or exchange of digital assets (crypto, tokens, NFTs) at 3%. The Finance Act 2025 reduced it to 1.5% from 1 July 2025. Whether any given trading product falls under it is a question for KRA.
